policies/DMCA TAKEDOWN NOTICE

In conformity with the Digital Millennium Copyright Act (DMCA), the BBF has instituted a process for responding to notices of alleged copyright infringement. If you believe some material on a site owned or controlled by the BBF (such as the BioBrick® Public Agreement website or the BioBricks Foundation website) is infringing your copyright, please send a notice to our DMCA agent (whose contact information is below) with the following information:

  1. A description of the infringing material;
  2. The location on our site(s) where the material is displayed, so that we can locate it (e.g., a URL);
  3. A signed (physical or electronic) statement that you are authorized to act on behalf of the owner of the copyright that you allege is being infringed, whether it is you or someone else;
  4. Your contact information, including address, telephone number, and e-mail address;
  5. A statement by you, made under penalty of perjury, that you have a good faith belief that the material identified is not authorized by the copyright owner, its agent, or applicable laws to be on our site, and that the information you have provided in your notice is accurate.

Please note that the BBF may forward on to a user whom you allege to be in violation of copyright a copy of the notice you have provided, including your name and contact information.

Counter-notification Procedure:

In the event that material you have posted to a site owned or operated by the BBF (such as the BioBrick® Public Agreement website or the BioBricks Foundation website) has been taken down, you may file a counter-notification with the BBF. Please include the following details:

  1. A description of the material that has been removed or to which access has been disabled;
  2. The location on our site(s) where the material was displayed (e.g., a URL);
  3. A statement by you, made under penalty of perjury, that you have a good faith belief that the material in question was removed or blocked due to a mistake or misidentification, and that the information you have provided in your counter-notification is accurate;
  4. A signed (physical or electronic) statement that you are authorized to act on behalf of the owner of the copyright for which you are filing this counter-notification, whether it is you or someone else;
  5. Your contact information, including address, telephone number, and e-mail address;
  6. A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if your address is outside the United States, the judicial district in which the BBF is located, and that you will accept service of process from the person who submitted a notice under the DMCA (as described above).
